Acceptance of Terms

Welcome to WildSafari ("Company," "we," "our," or "us"). These Terms and Conditions govern your access to and use of our website, booking platform, and on-site safari experiences located at Safari Park Road, Nairobi, Kenya.

By accessing our website, making a reservation, or participating in any WildSafari experience, you ("Guest," "Visitor," or "User") agree to be legally bound by these Terms. If you do not agree to any part of these Terms, you must not use our services.

Note: These Terms apply to all visitors, guests, booking agents, and third parties who interact with WildSafari services, whether online or in-person. These Terms may be updated periodically โ€” continued use of our services constitutes acceptance of any revisions.

Booking & Reservations

All safari tour bookings are subject to availability. A reservation is only confirmed once you receive a written confirmation email from WildSafari, typically within 2 hours of submission.

  • All bookings require a minimum deposit of 30% of the total tour cost at the time of reservation.
  • The remaining balance must be settled no later than 7 days before your tour date.
  • Walk-in bookings are accepted subject to availability but may be limited during peak seasons.
  • Group bookings of 10 or more require a separate group agreement and a 48-hour advance notice minimum.
  • WildSafari reserves the right to refuse or cancel any booking at our sole discretion.
  • All guest names and contact information must be accurate at the time of booking. Any errors are the responsibility of the Guest.

Third-Party Bookings: If you book through a third-party platform or travel agent, additional terms from that provider may apply. WildSafari is not responsible for any inaccuracies introduced by third-party booking channels.

Cancellation & Refund Policy

We understand that plans can change. Our cancellation policy is designed to be fair while accounting for operational costs and animal welfare staffing that cannot be reversed at short notice.

  • Cancellations due to documented medical emergencies will be reviewed on a case-by-case basis and may qualify for a credit voucher.
  • WildSafari reserves the right to cancel or reschedule tours due to severe weather, animal welfare concerns, or force majeure events. Full refunds or rescheduling will be offered in such cases.
  • Refunds are processed within 7โ€“10 business days to the original payment method.

Payment Terms

WildSafari accepts the following payment methods: major credit/debit cards (Visa, Mastercard, American Express), PayPal, bank transfer, and approved mobile payment platforms. All prices are displayed in USD unless otherwise stated.

  • All online transactions are encrypted using industry-standard SSL/TLS technology.
  • Prices listed are per person unless explicitly stated otherwise (e.g., Family Safari pricing).
  • Applicable taxes and service charges (typically 10โ€“15%) will be displayed at checkout before payment is processed.
  • WildSafari is not responsible for foreign transaction fees imposed by your bank or card provider.
  • Group discounts (15%+ for groups of 10+) must be requested at the time of booking and cannot be applied retroactively.

Price Guarantee: If you find the same tour at a lower price on another platform, contact us within 24 hours of booking and we will match the price.

Safety & Guest Conduct

The safety of our guests, staff, and animals is our highest priority. All guests must follow the instructions of WildSafari guides and staff at all times during their visit.

  • Guests must remain within designated safari zones and must not cross safety barriers under any circumstances.
  • Feeding, touching, or attempting to interact directly with any animal โ€” unless part of a specifically guided session โ€” is strictly prohibited.
  • Loud noise, sudden movements, flash photography near animals, and any form of animal harassment are prohibited.
  • Guests under the influence of alcohol or controlled substances will be denied entry or removed without refund.
  • Children under the age of 12 must be accompanied by a responsible adult at all times.
  • Any damage to WildSafari property, habitats, or equipment will be charged to the responsible guest.

Zero Tolerance Policy: Guests who violate safety rules or behave in a manner that endangers themselves, others, or our animals will be immediately removed from the park without refund and may be subject to legal action.

Health & Accessibility Requirements

Most WildSafari experiences are suitable for guests of all fitness levels. However, some tours involve outdoor terrain, walking, and extended periods of standing or seated observation.

  • Guests with serious cardiovascular conditions, severe mobility impairments, or recent surgeries should consult a physician before booking.
  • Pregnant guests are welcome on the Family Safari but should avoid the Night Safari and Jungle Safari due to terrain and duration.
  • Guests with severe allergies (insect stings, animal dander, outdoor allergens) must carry appropriate medication and notify our team at check-in.
  • Wheelchair-accessible routes and adapted safari vehicles are available upon request at no extra charge. Please specify at the time of booking.
  • WildSafari is not liable for health incidents arising from pre-existing conditions that were not disclosed at the time of booking.

Liability & Waivers

Participation in wildlife safari experiences involves inherent risks. By booking with WildSafari, guests acknowledge and accept these risks.

  • WildSafari maintains comprehensive public liability insurance and adheres to all applicable national safety regulations.
  • WildSafari is not liable for injury, loss, or damage resulting from a guest's failure to follow safety guidelines or guide instructions.
  • WildSafari's total liability to any guest shall not exceed the total amount paid by that guest for the specific tour or service in question.
  • Guests are strongly encouraged to obtain personal travel and medical insurance prior to their visit.

Liability Waiver: All adult guests must sign a digital liability waiver upon arrival. Unsigned waivers will result in denied entry without refund. Parents or guardians must sign on behalf of minors.

Photography & Media

Guests are welcome to take personal photographs and videos during their safari experience for non-commercial purposes.

  • Flash photography near animals is strictly prohibited as it causes distress and may trigger defensive behaviour.
  • Drone operation within WildSafari premises is prohibited without prior written approval from park management.
  • Commercial photography or filming (for advertising, media, or documentary purposes) requires a separate Media Access Agreement and fee.
  • By participating in WildSafari experiences, guests grant WildSafari permission to use any photographs or videos taken by our staff team that may include guests in marketing materials.
  • Guests who do not wish to be photographed must notify staff in writing prior to their tour.

Privacy Policy

WildSafari is committed to protecting your personal information. We collect and process data solely for the purpose of managing your booking and improving your experience.

  • Personal data collected includes name, email, phone number, and payment details โ€” stored securely and never sold to third parties.
  • We use industry-standard encryption for all data transmitted through our website.
  • Guests may request access to, correction of, or deletion of their personal data at any time by emailing privacy@wildsafari.com.
  • We may share data with trusted service providers (payment processors, email services) solely to deliver our services. These providers are contractually bound to protect your data.
  • Cookie usage on our website is governed by our separate Cookie Policy, which can be reviewed on our website footer.

Wildlife Interaction Guidelines

WildSafari is deeply committed to ethical animal welfare. All interactions with animals are strictly managed to prioritise the health, safety, and dignity of every animal in our care.

  • No guest may initiate unguided physical contact with any animal at any time.
  • Approved animal interaction experiences (e.g., elephant meet & greet, bird feeding) are conducted under direct supervision of trained keepers only.
  • Animals may be temporarily unavailable for viewing due to health, feeding schedules, or welfare reasons. No refunds are issued for species unavailability.
  • Guests who witness or suspect any form of animal mistreatment are encouraged to report it immediately to park management.

Intellectual Property

All content on the WildSafari website and materials โ€” including but not limited to text, graphics, logos, photography, video, and tour descriptions โ€” is the exclusive intellectual property of WildSafari or its licensed partners.

  • Reproduction, distribution, or commercial use of any WildSafari content without express written permission is strictly prohibited.
  • The WildSafari name, logo, and brand identity are registered trademarks and may not be used without written authorisation.
  • Educational or journalistic use of limited content is permitted provided clear attribution is given to WildSafari.

Governing Law & Disputes

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions.

  • Any disputes arising from or relating to these Terms shall first be addressed through good-faith negotiation between the parties.
  • If a dispute cannot be resolved informally, it shall be submitted to binding arbitration in Nairobi, Kenya, under the rules of the Nairobi Centre for International Arbitration.
  • Guests retain all rights granted to consumers under applicable Kenyan consumer protection legislation, which cannot be waived by these Terms.
